No Win, No Fee

There are different ways of funding your claim and Williamsons will always ensure to discuss the funding options with you and work out what the best option is for you.

Most claims are funded by a Conditional Fee Agreement; this is also known as a No Win, No Fee agreement and as the name suggests, if the claim is not ultimately successful, there will be no fee from Williamsons for the work carried out. This ensures that you don’t have to worry about legal costs if your claim is unsuccessful. The exception to this is if you acted dishonestly in bringing the claim or if you breached your agreement with us. This is very rare but in such circumstances, you may be liable for costs.

When funding a claim via a No Win, No Fee agreement, most people decide to also take out a police of insurance, called After the Event Insurance. This provides additional cover for third party costs, such as medical report fees and court fees, again to ensure that you don’t have to worry about legal costs.

If however you have Legal Expenses Insurance through your home or motor insurance policies or trade union cover, this may be the most suitable way to fund your claim. If you have such potential funding, we can liaise with legal expenses insurers and request that they fund the firm’s instruction on your behalf.

We are one of a select number of firms of solicitors who are approved to offer Legal Aid. It is however only able to be offered in appropriate cases, namely claims concerning serious neurological injuries suffered at or in the initial period following birth. If it is able to be offered to you, we will discuss the pros and cons of Legal Aid, as well as the pros and cons of a Conditional Fee Agreement, so that you can decide how you wish to proceed.
