    Can I make an Asbestosis Compensation Claim?

    The most important things to remember when making an Asbestosis Compensation claim:

    • You have three years from the date of your diagnosis or three years from the date of death from the disease to start a claim
    • If a family member has passed away or is too unwell to make the claim themselves, you can act on their behalf
    • Asbestosis compensation claims can be as high as £139,680

    Who can make an Asbestosis Claim?

    A claim can be brought by the person who has suffered the exposure to asbestos during their lifetime.

    If the person who has suffered asbestosis has since died, a claim can be pursued by the loved ones of the Deceased, both on behalf of the estate of the Deceased and on behalf of those who were dependent upon them.

    The Pneumoconiosis Compensation Act 1979

    The DWP operates a scheme that offers financial assistance to individuals unable to pursue a compensation claim. This allows you to receive funds for your asbestos-related illness, even if your employer’s insurer is untraceable or your former employer has gone out of business. You must apply as soon as you know you have diffuse pleural thickening and within 12 months of the date you became entitled to Industrial Injuries Disablement Benefit (IIDB).
