What is a Pleural Thickening Claim?

Pleural thickening can be caused by exposure to asbestos. It cannot be cured, but treatment may improve symptoms. It can take 20-30 years after being exposed to asbestos before symptoms start to appear. The risk of developing pleural thickening increases with the dose of asbestos the injured person has been exposed to.

If you have been exposed to asbestos during the course of your employment, even if the employment was many years ago and you have since retired, this can have significant consequences for your health. The asbestos fibres, if breathed in, can cause damage to the lungs; pleural thickening develops when scar tissue thickens the delicate lining around the lungs (the pleura).

The risk of developing Pleural Thickening and the extent of the disease increases with the dose of asbestos the individual has been exposed to. Pleural Thickening is associated with the risk of developing other asbestos related diseases in the future but does not in itself lead to other such illnesses.

    • You have three years from the date of your diagnosis or three years from the date of death from the disease to start a claim
    • If a family member has passed away or is too unwell to make the claim themselves, you can act on their behalf
    • Pleural thickening compensation claims often range from £35,000 up to £100,000
    • You could be entitled to claim compensation to cover the cost of your medical treatment
    • You can claim even if your previous employer has become insolvent

Who Can make a Pleural Thickening Claim?

If you have been diagnosed with pleural thickening due to asbestos exposure, you can make a claim.

You can claim on behalf of a loved one who has died from plural thickening caused by asbestos exposure.

Common types of employment in which exposure to asbestos could have occurred are:

    • Construction
    • Plumbers
    • Joiners
    • Engineers
    • Dockyard workers

Common symptoms of pleural thickening include:

    • Chest pain
    • Difficulty catching your breath
    • Difficulty/Inability to take a deep breath
    • Persistent cough
    • Extreme tiredness/Fatigue
    • Fever
    • Pain when exhaling or inhaling
    • Shortness of breath, especially after or during exertion

Against Whom is the Claim Made?

Claims are typically brought against the employer or organisation responsible for the asbestos exposure. Even if the company is no longer in business, their insurer will handle the claim. In cases where the insurer is out of business or cannot be found, a backup scheme ensures that you are compensated.

    The Pneumoconiosis Compensation Act 1979

The DWP operates a scheme that offers financial assistance to individuals unable to pursue a compensation claim. This allows you to receive funds for your asbestos-related illness, even if your employer’s insurer is untraceable or your former employer has gone out of business. You must apply as soon as you know you have diffuse pleural thickening and within 12 months of the date you became entitled to Industrial Injuries Disablement Benefit (IIDB).

    Making a Pleural Thickening Claim

We can discuss your case with a free initial consultation to understand your concerns, which may include taking forward your claim on a ‘NO WIN NO FEE’ basis.

We work on a conditional fee basis, ensuring you don’t have to worry about legal costs if your claim is unsuccessful.

You have a period of three years from your mesothelioma diagnosis to initiate a claim. This is referred to as the limitation period.

If you are making a claim on behalf of someone who has passed away, you have three years from the date of their death or from the date a post-mortem examination confirmed asbestos exposure as the cause of death.
