Compensation Protection Services

There are many different reasons why a Personal Injury Trust is created. The most common reason is due to an award of compensation resulting from a personal injury or clinical negligence claim. The money received is often substantial and the Trust provides protection for your ongoing needs.

A Personal Injury Trust protects your award from assessment for means-tested benefits. This means you will not lose that entitlement. Even if you do not currently receive means-tested benefits you may in the future and if your damages are held in the Trust then they will be disregarded for assessment.

If you have an ongoing compensation claim with Williamsons, we can work with you and your compensation specialist to manage your award. We understand that every client’s needs are unique and require individual consideration on a case-by-case basis.

  • Applying to the Court of Protection to appoint a Deputy or Williamsons as a Professional Deputy;
  • Creating and administering Trusts whilst litigation is ongoing and upon settlement;
  • Applying to the Court of Protection (if necessary) to authorise the creation of an appropriate Trust to hold an award of compensation;
  • Acting as Professional Deputy or Professional Trustee, either as a sole appointment or alongside family members;
  • Assisting in the management of a team of professional advisers to provide a support package, which can involve working alongside case managers, carers, therapists, welfare benefits experts, accountants, financial advisers and other professionals ensuring they act in your best interests;
  • Dealing with property purchases on behalf of a Deputy or Trustee; and
  • Preparing a Will to help protect an award of compensation for future generations.
